Civil Protection Plan
Chapter 1 General Provisions
Section 1 Purpose of the plan
This plan aims to contribute to the accurate and prompt implementation of measures for the protection of citizens in the event of situations involving armed attacks, as stipulated in Article 36, paragraph 2, and Article 182, paragraph 2, of the Law Concerning Measures for the Protection of the People in Armed Attack Situations and Other Situations (Law No. 112 of 2004, hereinafter referred to as the “Civil Protection Law”), and based on the Kagoshima Prefecture Civil Protection Plan established under the same law. These measures, referred to as “civil protection measures,” pertain to our company’s operations in situations involving armed attacks (referred to as “situations of armed attack and anticipated situations of armed attack,” hereinafter the same).
It should be noted that civil protection measures are limited to activities within the scope of current laws and regulations, and there is no need to carry out activities beyond this scope.
Section 2 Basic Policy
In situations involving armed attacks, based on the Civil Protection Law, other relevant laws, basic guidelines for the protection of citizens (decided by the Cabinet in March 2005), and this plan, we will strive to ensure the accurate and prompt implementation of civil protection measures by coordinating and cooperating with other organizations while obtaining the cooperation of the public. In doing so, the following points shall be noted:
- Information Provision to the Public
•Efforts shall be made to promptly provide information to the public about civil protection measures through various means such as newspapers, broadcasting, and the Internet. - Coordination with Relevant Agencies
・Efforts shall be made to establish a framework for collaboration with relevant agencies in advance regarding civil protection measures. - Autonomous Judgment in Implementing Civil Protection Measures
•In implementing civil protection measures, autonomous judgment shall be exercised based on information provided by prefectures and municipalities, tailored to the circumstances of situations involving armed attacks. - Accurate Implementation of International Humanitarian Law for the Elderly, Disabled, etc.
•Consideration shall be given to the elderly, disabled, etc., in the implementation of civil protection measures.
•Measures shall be taken to ensure the accurate implementation of international humanitarian law, including the use of special markings, applied in international armed conflicts. - Ensuring Safety
•In implementing civil protection measures, due consideration shall be given to the safety of employees and other personnel engaged in civil protection measures, with the cooperation of prefectures and municipalities. - Comprehensive Coordination by the Prefectural Response Headquarters Chief
•Efforts shall be made to promptly and accurately implement necessary measures based on the results of comprehensive coordination conducted by the Chief of the Kagoshima Prefecture Civil Protection Response Headquarters.
Chapter 2：Preparedness for normal times
Section 1: Establishment if an operational structure
- Establishment of the Company’s National Protection Liaison and Coordination Council
・To facilitate internal communication and coordination regarding civil protection measures and emergency response related to our company’s operations, a permanent liaison and coordination organization, referred to as the “Company Civil Protection Headquarters” (hereinafter referred to as “Headquarters”), shall be established within the Business Headquarters.
•Matters concerning the organization and operation of Headquarters shall be separately determined. - Establishment of Information Communication Structure
( 1 ) Establishment of Information Collection and Communication Structure
・To promptly collect and summarize information such as the status of damage to managed vessels and facilities, the implementation status of civil protection measures, and operational conditions, necessary items such as communication networks, methods, and procedures shall be predetermined.
( 2 ) Establishment of Communication System
・In armed attack situations, etc., the necessary communication system shall be established, taking into consideration coordination with relevant agencies, to enable rapid and reliable communication. - Establishment of Emergency Assembly and Operational Structure
・In order to promptly establish the necessary systems in the Company for the accurate and rapid implementation of national protection measures in armed attack situations, etc., the necessary matters regarding the emergency gathering of relevant personnel, etc., shall be stipulated in advance and made known to relevant personnel. - Appropriate management of special emblems, etc.
・When the Governor of Kagoshima Prefecture (hereinafter referred to as the “Governor”) grants permission for the use of special badges, etc., if prior permission from the Governor is required, an application for permission shall be made to the Governor in advance, and proper management shall be conducted.
Section 2 Establishment of a system for communicating warnings or instructions for evacuation measures, etc.
・In the event of receiving notification of an alarm or instructions to evacuate from the Governor, the necessary matters such as the place to communicate the alarm, etc. within the company, etc., and the procedures for each category shall be established.
Section 3 Preparedness for facilities on ships and other vessels under management
•In the event that facilities such as ships under their control are designated as evacuation facilities by the prefectural governor, efforts shall be made to establish the necessary systems to ensure that evacuees are properly received.
Section 4 Conducting drills
•In the event of a disaster, the local authorities shall endeavour to conduct internal drills in order to ensure that appropriate national protection measures can be implemented, and shall also endeavour to participate in drills on national protection measures conducted by the prefecture or municipality.
Section 5 Stockpiling
・The company shall endeavour, to the extent it is able to do so, to ensure that stockpiles for disaster prevention, stockpiles and stockpile quantities, stockpile locations and supply destinations of goods and materials are known, so that stockpiling for national protection measures and stockpiling for disaster prevention can be combined with each other.
Chapter 3 Coping with armed attack situations
Section 1 Establishment of operational structure
- Response to armed attack situation headquarters, etc.
・In the event that the Governor of a prefecture informs us of the establishment of a National Protection Headquarters, we shall promptly inform the company, etc., in accordance with the notification of an alarm. - Operation of the Company’s national protection task force, etc.
・In the event of the establishment of a Kagoshima Prefectural Civil Protection Headquarters, the Company’s Civil Protection Headquarters (hereinafter referred to as ‘Headquarters Headquarters’) shall be operated. - Information gathering and reporting
( 1 ) Information gathering and reporting
・The HQ task force shall swiftly collect information on armed attack situations, including the status of damage to ships and other facilities under its control, the status of implementation of measures to protect the public, and the status of ship operations.
( 2 ) Ensuring communication systems
・In order to secure the means of communication necessary for the implementation of national protection measures, necessary measures shall be taken for the emergency restoration of information and communication facilities that have been damaged. In addition, the Ministry of Internal Affairs and Communications shall be immediately informed of the status of the camphor. - Implementation of emergency mobilisation
・In order to implement the national protection measures accurately and promptly, emergency mobilisation of relevant personnel shall be carried out as necessary, as separately specified.
Section 2 Ensuring Safety
・In implementing national protection measures, special emblems and identity cards under Article 158(1) of the National Protection Act shall be used appropriately in accordance with the authorisation of the County Governor.
Section 3 Transmission of warnings
・In the event that the Prefectural Governor notifies the shipowner of an alarm, the shipowner shall ensure that the alarm is communicated promptly and reliably within the company, as well as to the users of the ship and other facilities, as separately specified. The same shall apply when an instruction to lift an alarm is given.
Section 4: Measures for evacuation and rescue
- Notification and communication of evacuation instructions
・In the event of notification of an evacuation order from the Governor of the Prefecture, the instructions shall be communicated promptly and reliably within the company, as separately stipulated. The same shall apply in the event of an instruction to lift the evacuation. - Preparations for the transport of evacuated residents
・In the event that the prefecture issues an evacuation order, the company shall maintain close contact with the prefecture and, if necessary, prepare for a request from the prefectural governor or the mayor of the municipality for the transportation of evacuated residents, and establish the necessary systems for the transportation of evacuated residents, including the securing of transport capacity.
・In the event of notification of evacuation implementation guidelines from the municipality, the information shall be shared internally and efforts shall be made to ensure that the necessary systems are in place following the content of the guidelines. - Support for evacuation and rescue
• If evacuees are to be received at facilities such as vessels under their control, which have been designated in advance as evacuation facilities by the prefectural governor, efforts shall be made to take the necessary measures to open such evacuation facilities.
Section 5 Appropriate management and safety of ships and other facilities
・When it becomes necessary to guide users of facilities or passengers on vessels or other facilities under their control, they shall make efforts to guide them appropriately, based on accurate and prompt decisions, in the same way as when responding to disasters or accidents.
Section 6 Securing transport
- Transport of evacuated residents
In the event of a request from the governor or mayor of a municipality for the transportation of evacuees, transport shall be carried out accurately and promptly, unless there are justifiable reasons why such transportation cannot be carried out due to malfunctioning of equipment or materials, etc. - Maintenance of transport
・In the event of an armed attack on a ship or vessel, the following measures shall be taken to ensure the proper carriage of passengers and cargo: – Confirmation of the status of ships, vessels and other facilities necessary for carriage; – Maintenance of order through announcements at passenger facilities and passenger guidance; – Measures necessary for the proper carriage of passengers and cargo in an armed attack situation, etc.
Section 7: Collection of safety information
・In order to ensure the smooth implementation of the collection of safety information by prefectures and municipalities, efforts shall be made to cooperate in the collection of safety inertia reports by prefectures and municipalities, such as by providing safety information in response to enquiries, within the scope of their duties.
・When cooperating with the collection of safety reports by prefectures and municipalities, in principle, safety information shall be provided to the head of the local government where the evacuated residents subject to safety information and those killed or injured in an armed attack disaster are currently located, and the head of the local government shall be informed of the address of the person concerned.
Chapter 4 Emergency restoration
・In the event of an armed attack disaster, emergency inspections of the facilities and equipment of ships and other vessels under their control, as well as those related to the measures taken for the protection of the public as part of their duties, shall be carried out promptly, giving due consideration to ensuring safety, to ascertain the state of damage, etc., and to take prompt measures for emergency restoration. The Headquarters Response Headquarters shall endeavour to implement emergency restoration measures as necessary.
・The HQ task force shall report on the damage and the implementation of emergency restoration measures to the Ministry of Land, Infrastructure, Transport and Tourism and the prefecture, as necessary.
Chapter 5: Dealing with emergency response situations
・The implementation system for emergency response and protection measures, as well as the content and method of implementation of the measures, shall be in accordance with the provisions of Chapters 1 to 4 of this Plan.
Chapter 6: Appropriate review of the plan
・The plan shall be reviewed in a timely manner and, if deemed necessary, shall be voluntarily amended, and any amendments shall be reported to the prefectural governor, except in the case of minor amendments. The plan shall also be notified to the prefectural governors and municipalities concerned, and shall be published on the website.
・The following are some of the key elements of this plan.
・The plan shall be revised by the Municipality in accordance with the following steps: – When it is deemed necessary to revise this plan, the Municipality shall request the heads of local governments, designated public bodies and designated local public bodies, and other relevant persons to provide materials and information, to state their opinions and to provide other necessary cooperation.
